Isisekelo salokhu yizindima ze-Quran kanye ne-Hadith.
Ekuqinisweni, eKoran, ngemuva kokuba kushiwo ukuthi isehlukaniso senziwa kabili, bese kuthi ngemuva kwalokho, noma umuntu amgcine ngobuhle noma amkhulule ngobuhle (Al-Baqarah, 2:229), ivesi elilandelayo lithi:
“Uma indoda iphinda imlahle umkayo (okwesithathu), akabe esamvumelekile ukuba amshiye, kuze kube yilapho umfazi eseshade nenye indoda. Nokho, uma le ndoda entsha imlahla naye, uma bobabili (indoda yokuqala nomfazi wayo) becabanga ukuthi bazogcina imithetho kaNkulunkulu, akukho cala kubo ukuba babuyelane (ngemuva kokuphela kwesikhathi sokulinda).”
(Al-Baqarah, 2:230).
Ngokwale ndima kanye neminye imithetho yamaSulumane, umshado osemthethweni ngu-
izimo ze-hullene
yilezi:
1)
Umfazi oqalaqwe kathathu ngaxeshanye okanye ngamaxesha ahlukene uya kugqiba iddah yakhe.
2)
Ngemva kwalokho, uzoshada nomunye umuntu, ngomshado osemthethweni.
3)
Ushaka wakhe wesibili uzokwenzela umshado.
4)
Lolu shadi yesibili izophela ngokufa noma ngesehlukaniso.
5)
Owesifazane uzobe eseqedile isikhathi sakhe se-iddah (isikhathi sokulinda ngemuva kokudivosa noma ukushona komyeni) kumyeni wakhe wesibili.
Nokho, ngemva kokuba le mibandela isifezekile, indoda ingashada futhi nowayengumkayo owayeshadwe naye kathathu (el-Cassâs Ahkâmü’l-Kur’ân, Âsitâne, thk. Muhammed es-Sâdik, Dâru’l Mushaf, Kahire, ts., ll, 88, 89; Mehmed Zihni, Münâkehât ve Mufârekât, İstanbul 1324/1906, s. 43-45).
Umprofethi uMuhammad (ukuthula kube kuye) waqalekisa umuntu owenza umshado wenkontileka (muhallil) kanye nalowo owenza ukuthi wenziwe (muhallelün leh), futhi waqalekisa owokuqala…

usebenzise le nkulumo. (Ibn Majah, Nikah, 33; Tirmidhi, Nikah, 28; Nasai, Talaq, 13; Ahmad b. Hanbal, Musnad, I, 83, 87, 93).
U-Abdullah bin Abbas (w. 68/687) wabuza uMprofethi (s.a.w.) ngesimo salowo owenza umshado wenkontileka (muhallil), wabe esephendula ngale ndlela:
“Cha, kodwa umshado owenziwe ngokuzithandela uyavumelekile, hhayi umshado owenziwe ngobuqili, futhi akukhona ukuhlekisa ngencwadi kaNkulunkulu. Ngemuva kwalokho, indoda yesibili nayo kufanele ilale naye.”
(et-Tâc, II/313).
Umka Rifa’a al-Kurazi waya kuMprofethi (ukuthula kube kuye) wathi,
“URifa’a wangitala ngokuqinisekile ngesithathu. Ngase ngishada no-Abdurrahman b. Zubeyr (wafa ngo-72/691). Kodwa naye (isitho sakhe sangasese) saphuma siyindwangu.”
usho kanjalo. Umprofethi (ukuthula nokubusiswa kukaNkulunkulu kube phezu kwakhe) wamoyizela;
“Ngakho, siphinde safika eRifaa?”
Ufuna ukwenza ucansi? Kodwa wena, ngeke ukwazi ukwenza ucansi naye (u-Abdurrahman) ngaphandle kokuthi naye alambise ingquza yakho, nawe ulambise ingquza yakhe.”

Lapha, kubonakala ukuthi owesifazane owayengumngane womprofethi (ukuthula nokubusiswa kukaAllah kube kuye) wabuza ngokuqondile umbuzo oyimfihlo kakhulu mayelana nomyeni wakhe, futhi uMprofethi (ukuthula nokubusiswa kukaAllah kube kuye) wawuphendula ngendlela evamile, wabe esemtshela isinqumo.
