Ngabe umyeni angahoxisa isehlukaniso esibekiwe (njengokuthi, “uma wenza lokhu, usuhlukene nami”) ngaphambi kokuba umbandela ugcwaliseke?

– Uma indoda ithi kumkayo, “Uma wenza lo msebenzi, ngizokudivosa,” bese umfazi ENGAWENZI lo msebenzi… (ngakho-ke akahlukanisiwe) bese kudlula izinyanga ezi-5 noma ezi-6, bese indoda ithi, “Noma wenza lo msebenzi manje, awuhlukanisiwe… ngiyawuhoxisa umyalo wokuqhekeka,” bese umfazi enza lo msebenzi, kwenzekani?

– Ngakho-ke, indoda ingakwazi yini ukuhoxisa isibopho sesahlukaniso?

– Ngiyathola ukuthi kubonakala sengathi akukho ukubuyela emuva… kodwa angiqinisekile… ngoba ngihlale ngibona lokhu ezimpendulweni zemibuzo efanayo. Ngokwesibonelo, uma indoda ithi kumkayo, “Uma uya ekhaya kwabakini, usukhululekile,”… izincwadi zama-fiqh zihlala zithi: “Umfazi uya ekhaya kwabakini, bese kuba khona isehlukaniso esisodwa, kusele izisehlukaniso ezimbili.” Akukho ndawo lapho kuthiwa khona ukuthi isehlukaniso singabuyiselwa emuva!!

– Ngemva kwesikhathi esithile, akusathiwa “ungaya ekhaya kuyihlo, awungeni lutho”… okusho ukuthi lesi sixazululo akuzange kufikele muntu engqondweni.

Yingakho ngizibuza ngiyazibuza, ngingabaza ngoba ngiqhathanisa. Ngibuzile kini nginethemba…

Impendulo

Mthandiwe, mzalwane wethu,

Isitatimende somyeni esibonisa inhloso yakhe yokudivosa singaba esingenamibandela, noma singaboshwe ngombandela (umbandela wokulibazisa) noma isikhathi esithile.

Akukho ukubuyela emuva esivumelwaneni sesehlukaniso esibekiwe ngaphambi kokuba isimo esibekiweyo senzeke.

Uma isehlukaniso sinemibandela, isehlukaniso siba nesiqalo sokusebenza uma leyo mibandela isifezekile.

Kuze kube leyo mbandela ifezekile, umshado uyaqhubeka nawo wonke umthetho nemiphumela yawo.

Kodwa uma isehlukaniso sibekwe ngaphansi kwesibopho, bese isehlukaniso senzeka ngenye indlela ngaphambi kokuba isibopho sifezeke, bese isibopho sifezeka ngemuva kokuphela kwesikhathi sokuqapha, isehlukaniso sase sifezekile, ngakho-ke isibopho asisasebenzi.

Kuyenzeka ukuthi isifungo sisetshenziselwe ukuqinisa incazelo yegama elisho isehlukaniso esinombandela. Kulokhu, ngokuvumelana nabaningi abahlaziyi be-fiqh, lokhu nako kuyisehlukaniso esinombandela esivumelekile; isehlukaniso siyenzeka uma umbandela usufikeleleka.

Nokho, ngokwezinye izazi ezifana no-Ikrime, u-Shureyh, u-Ibn Taymiyyah, no-Ibn al-Qayyim, uma inhloso yomyeni ingekona ukudivosa, kodwa ukufunga ukuze umkakhe enze noma angayenzi into ethile, lokhu akusona isehlukaniso esinombandela; ngakho-ke, noma ngabe umbandela ufezekile, isehlukaniso asenzeki. Kudingeka kuphela ukukhokha isifungo ngoba asizange sigcwaliseke.
